Terms of Service

1. The agreement

These terms are a contract between you and Funnelful ("we", "us") covering your use of Funnelful Ads — the web application, its AI production agent, and everything it generates (together, "the Service"). By creating an account or using the Service you agree to these terms. If you use the Service on behalf of a company, you confirm you can bind that company.

2. What the Service is

Funnelful Ads is an AI-assisted advertising production studio: it researches products, drafts marketing angles, and generates video and static ad creative on your instructions. It is a tool, not an agency — you direct the work and you decide what gets published.

3. Accounts

• You must be at least 18 years old.
• Keep your registration details accurate and your password private.
• You are responsible for everything done through your account.

4. Subscription and billing

• Access requires a paid subscription. Prices are shown at checkout and billed monthly in advance through our payment processor, Stripe. We never see or store your card number.
• Subscriptions renew automatically until cancelled.
• You can cancel any time from the billing portal in your account settings. Cancellation takes effect at the end of the period you already paid for; until then you keep full access.
• We will give you at least 30 days' notice before any price change takes effect for you.

5. Credits

• Generation work is paid for with credits. Your plan includes a monthly credit grant, and you can buy top-up packs. Credits do not expire and stack with your existing balance.
• Credits are a prepaid means of using the Service only: they have no cash value, cannot be transferred or sold, and are not redeemable for money except where the law requires it.
• Credits spent on completed generations are not refundable. If a generation fails on our side, the corresponding credits are not charged or are restored.

6. Your content and generated output

• You keep ownership of everything you upload. You give us the limited license needed to store and process it to operate the Service.
• As between you and us, you own the ad creative the Service generates for you, to the extent permitted by applicable law and the terms of the underlying AI model providers.
• You are responsible for having the rights to what you upload (product photos, brand assets, inspiration material) and for how you use the output.

7. Acceptable use

Do not use the Service to:

• create deceptive, unlawful, or infringing advertising, or ads for illegal products;
• generate content that impersonates real people without their consent;
• probe, overload, or interfere with the Service or other customers' use of it;
• resell access, share one account across a team, or scrape the Service.

8. AI output — important

Generated content can be wrong. The Service uses AI models that can produce inaccurate claims, unrealistic imagery, or content that violates an ad platform's policies. You must review everything before publishing. You are solely responsible for the accuracy of the claims in your ads and for complying with advertising law and platform rules (including FTC disclosure requirements) in the markets where you run them.

9. Third-party services

The Service is built on third-party providers — Stripe for payments, cloud infrastructure for storage, and external AI model providers for generation. Their availability affects ours, and your use of the Service must also respect their applicable terms.

10. Suspension and termination

We may suspend or terminate accounts that violate these terms or create risk for the Service or other customers. You may stop using the Service and cancel at any time. Sections 5–8 and 11–12 survive termination.

11. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. To the maximum extent permitted by law, our total liability for any claim arising out of the Service is limited to the amounts you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, or consequential damages, including lost profits or lost ad spend.

12. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.

13. Changes and contact

We may update these terms; material changes will be announced in the app or by email before they take effect. Continued use after the effective date is acceptance. Questions: support@funnelful.app.
